A CCJ (Comissão de Constituição e Justiça) da Câmara dos Deputados aprovou, nesta segunda-feira (20), o relatório da PEC 11/2022 (Proposta de Emenda à Constituição), de autoria da senadora Eliziane Gama (Cidadania-MA), determinando que lei federal instituirá pisos salariais profissionais nacionais para os enfermeiros, técnicos de enfermagem, auxiliares de enfermagem e parteiras.
“A admissibilidade na CCJ é o primeiro passo da tramitação da PEC, que dará segurança jurídica ao piso salarial da enfermagem”, afirmou a parlamentar na rede social.
Na prática, a proposta evita que tribunais de Justiça apontem vício de iniciativa – quando uma proposta é apresentada por um dos Poderes sem que a Constituição lhe atribua competência para tanto – no projeto de lei do piso da Enfermagem (PL 2564/2020).
De acordo com Eliziane Gama, a inserção na Constituição dos pisos salariais para essas categorias evita uma eventual suspensão na Justiça do PL 2564/2020, já aprovado pelo Congresso Nacional.
Proposto pelo senador Fabiano Contarato (PT-ES), o projeto prevê piso salarial de R$ 4.750 para os enfermeiros. O texto fixa remuneração equivalente a 70% do piso nacional como mínimo para técnicos de enfermagem. Para auxiliares de enfermagem e parteiras, o valor será equivalente a 50%.
A PEC será analisada agora por uma comissão especial da Câmara quanto ao mérito e, se for aprovado, seguirá para o plenário. A matéria precisará ser votada em dois turnos. Em caso de mudanças, o texto voltará ao Senado, onde iniciou a tramitação.
