O ferryboat José Humberto, que veio do Estado do Pará, para fazer a travessia entre São Luís e Alcântara, no Maranhão, ainda não foi liberado para o uso pela Marinha.

Segundo o Ministério Público do Maranhão, a embarcação passa por reparos e, uma análise inicial da Capitania dos Portos, reprovou o ferry.

A embarcação, de 38 anos, funcionava como uma balsa e foi pintada e adaptada para operar no transporte aquaviário de passeiros e carros, entre a Ponta da Espera e o Cujupe. Na última sexta-feira (3), representantes da Capitania dos Portos do Maranhão fiscalizaram o ferryboat

Em documento divulgado nessa terça-feira (7), O Ministério Público enviou um ofício à Procuradoria da República, para pedir cooperação do Ministério Público Federal (MPF), no sentido de acompanhar o trabalho a Capitania dos Portos, no procedimento de emissão dos documentos da embarcação José Humberto. O pedido foi acatado pela Procuradoria.

Para a promotora do consumidor, Lítia Cavalcante, há uma precarização na prestação dos serviços.

“Eles estão querendo contratar um ferry que passou o final de semana passando por serviço. Eu tenho informações concretas de que o ferry não foi aprovado pela Marinha e ela já tem o ofício para responder. Mas, também, os serviços foram feitos porque o ferry não é adequado para a baía, ele não tem motor de propulsão. Ele tem a metade da velocidade dos nossos ferry, ele é inadequado à Baía de São Marcos.

Fora isso, é um ferry de rio, então, vão colocar a população em um ferry desses que, inclusive está apresentando problemas graves e tanto que a Marinha não aprovou para população ir e fazer esse trajeto. Enfim, a gente está fazendo o que tem que ser feito. Agora, gestor nós não somos, o que a gente pode fazer é ajuizar, entrar com as ações devidas, investigar, mas quem tem a gestão é o Estado do Maranhão”, destaca Lítia Cavalcante.

Atualmente a travessia entre a Ponta da Espera e o Cujupe conta com apenas três ferries, de propriedade da empresa Internacional Marítima. Antes, chegava a sete embarcações. O número tem se mostrado insuficiente diante da demanda que só cresce. O resultado são filas e cancelamentos, que ficaram mais evidentes nas últimas semanas.

Nesta quarta-feira (8), o MP-MA instaurou mais dois inquéritos, na cidade de Guimarães e Mirinzal, na baixada. Eles se juntam ao inquérito que já está em andamento na Promotoria do Consumidor da capital. Enquanto isso, os passeiros enfrentam os problemas do transporte aquaviário.

“Está havendo uma superlotação porque o serviço não está sendo prestado a contento, e, na verdade, nunca esteve, nem no começo. E nunca, nunca esteve tão pior”, afirma a promotora do consumidor.

A Serviporto, que está sob o comando do Governo do Maranhão desde 2020, e fornecia embarcações para a travessia, teve a intervenção estatal prorrogada por mais 180 dias. O advogado da empresa diz que a medida é ilegal.

“Adentramos com cinco ações no poder judiciário e não se sabe porque essas ações não seguem. Nós não temos previsão de que haja uma decisão judicial, mas, nós esperamos que o poder judiciário aplique a justiça e devolva à empresa privada o que ele sabe fazer, que é fazer gestão como tem feito nos últimos 35 anos. O que nós queremos é que o governo nos entregue a empresa, nós iremos buscar uma solução para o caso”, declara Antônio Fernandes, advogado da Serviporto.

O advogado diz ainda que a Serviporto ficou de fora da licitação realizada no passado, por conta de uma manobra do governo. Quem venceu foi uma empresa sem ferryboat e nem capital social.

“Entramos na Justiça, a empresa que ganhou, como já se sabia, não tinha ferryboat para apresentar, mas, até o presente momento a licitação ainda não foi cancelada”, afirma o advogado.

Por meio de nota, a Agência de Mobilidade Urbana (MPB) disse que rescindiu o contrato com as empresas que venceram o último processo licitatório, por causa do não cumprimento de pontos do edital. A MOB disse, ainda, que uma nova licitação será aberta, mas não disse quando.

Quanto a embarcação José Humberto, a MOB informou que aguarda o laudo da Marinha para prosseguir com os trâmites de autorização de operação da embarcação, mas não se manifestou em relação aos fatos apontados pelo Ministério Público Estadual de que a embarcação passa por reformas e que não é a indicada para a travessia na Baía de São Marcos.
