“A democracia venceu e precisamos trabalhar pela pacificação do país”
O ministro Luís Roberto Barroso tomou posse, nesta quinta-feira (28), na Presidência do Supremo Tribunal Federal (STF) e do Conselho Nacional de Justiça (CNJ) com uma defesa da criação de consensos visando ao desenvolvimento e à consolidação da democracia brasileira. “A democracia venceu e precisamos trabalhar pela pacificação do país. Acabar com os antagonismos artificialmente criados para nos dividir”, afirmou.
Para o novo presidente da Corte, é preciso que o país se aglutine em torno de denominadores comuns, “de uma agenda para o Brasil”.
Entre os temas que devem ser objeto de consenso estão o combate à pobreza, o desenvolvimento econômico e social sustentável, a prioridade para a educação básica, a valorização da livre-iniciativa e do trabalho formal e a liderança global em matéria ambiental.
Nesse sentido, três elementos são essenciais: integridade, civilidade e confiança.
“Todos eles vêm antes da ideologia, antes das escolhas políticas pessoais”, ressaltou.
Eixos da gestão – Barroso anunciou que sua gestão se dará em torno de três eixos: que visam a aumentar a eficiência da Justiça:
- Avanco da pauta dos direitos fundamentais e contribuir para o desenvolvimento econômico, social e sustentável do Brasil;
- comunicação, que envolve melhorar a interlocução com a sociedade e explicar didaticamente as decisões, “desfazendo incompreensões e mal-entendidos”;
- Relacionamento, que implica a abertura para a sociedade.
“A gente na vida deve ser janela e não espelho, ter a capacidade de olhar para o outro, e não apenas para si mesmo”.
Segurança – Outro ponto que deve ser enfatizado na gestão do novo presidente é a segurança – jurídica, democrática e humana. A primeira deve proporcionar um bom ambiente para o desenvolvimento econômico, “sem surpresas”.
A segurança democrática diz respeito a eleições limpas, liberdades públicas, independência entre os Poderes e respeito às instituições. Por sua vez, “como princípio e fim”, a segurança humana inclui o combate à pobreza, às desigualdades e à criminalidade, “com segurança pública e valorização das polícias, treinadas numa imprescindível cultura de respeito à cidadania e aos direitos humanos”.
O presidente do STF disse que pretende ouvir a todos – trabalhadores e empresários, comunidades indígenas e agricultores, produtores rurais e ambientalistas, gente da cidade e do interior. “E, também, conservadores, liberais e progressistas”, destacou.
“A vida na democracia é a convivência civilizada dos que pensam diferente”.
Gratidão – A primeira parte do discurso foi dedicada “ao reconhecimento às pessoas que pavimentaram o meu caminho até aqui” – sua família, a “legião de amigos”, servidores e assessores. Barroso também prestou reconhecimento a professores, desde o Colégio de Vassouras às Universidades de Yale e de Harvard.
Ao homenagear a ministra Rosa Weber, que deixa a Presidência do STF, o ministro lembrou sua trajetória da magistratura e sua atuação “em um dos momentos mais dramáticos de nossa história”, liderando a reconstrução do Plenário após os ataques de 8 de janeiro. “Em nome da nação agradecida, em nome dos que sabem distinguir as grandes figuras da história deste Tribunal, eu a reverencio pelos imensos serviços prestados ao Brasil”, afirmou.
Desenho institucional – Ao falar do papel do STF, o novo presidente ressaltou que a Constituição da República, além de demarcar a competência dos Poderes e definir direitos e garantias dos cidadãos, contempla os sistemas econômico, tributário, previdenciário, de educação, de preservação ambiental, da cultura, dos meios de comunicação, da proteção às comunidades indígenas, da família, da criança, do adolescente, do idoso, em meio a muitos outros temas.
“Incluir uma matéria na Constituição é, em larga medida, retirá-la da política e trazê-la para o Direito. Essa é a causa da judicialização ampla da vida no Brasil. Não se trata de ativismo, mas de desenho institucional”, assinalou.
Contudo, Barroso defendeu que o Tribunal aja com autocontenção e em diálogo com os outros Poderes e a sociedade. “Numa democracia não há Poderes hegemônicos”, ressaltou, “garantindo a independência de cada um, conviveremos em harmonia, parceiros institucionais pelo bem do Brasil”.
União – A união da Corte também foi ressaltada pelo ministro. “Estivemos mais unidos do que nunca na proteção da sociedade brasileira na pandemia. E, também, estamos sempre juntos, em sólida unidade, na defesa da democracia”.
Barroso lembrou que, recentemente, em todo o mundo, a democracia constitucional viveu momentos de sobressalto, com ataques às instituições e perda de credibilidade. “Por aqui, as instituições venceram, tendo ao seu lado a presença indispensável da sociedade civil, da Imprensa e do Congresso Nacional”.
Apesar dessa vitória, ele ponderou que as democracias contemporâneas ainda têm desafios a equacionar e vencer: a inclusão social, a luta contra as desigualdades e o aprimoramento da representação política.
Direção certa – Barroso destacou o papel do STF e do Poder Judiciário na proteção dos direitos fundamentais.
“Nessa matéria, temos procurado empurrar a história na direção certa”, afirmou, lembrando o reconhecimento dos povos indígenas, das pessoas com deficiência, a preservação do meio ambiente, a ascensão das mulheres, a luta da população negra e o reconhecimento de direitos da comunidade LGBTQIA+.
“Há quem pense que a defesa dos direitos humanos são causas progressistas. Não são. Essas são as causas da humanidade, da dignidade humana, do respeito e consideração por todas as pessoas”.
Judiciário – Ao falar, também, como presidente do CNJ, Barroso ressaltou a independência e a produtividade do Judiciário brasileiro e destacou dois pontos que merecerão sua atenção: aumentar a participação de mulheres nos tribunais e ampliar a diversidade racial. “Além disso, com inovações tecnológicas e Inteligência Artificial, vamos procurar aumentar a eficiência e a celeridade da tramitação processual no Brasil”, afirmou.
Valores – Ao encerrar seu pronunciamento, Barroso reafirmou os valores que já havia manifestado na sua posse como ministro do STF, há dez anos.
“Creio no bem, na justiça e na tolerância como valores filosóficos essenciais. Creio na educação, na igualdade, no trabalho e na livre iniciativa como valores políticos fundamentais. E no constitucionalismo democrático como forma institucional ideal”, pontuou.
“Assumo a Presidência do Supremo e do CNJ sem esquecer que sou, antes de tudo, um servidor público. Um servidor da Constituição. Que eu possa ser abençoado para cumprir bem essa missão”, concluiu.
