Presidente do STF disse que pretende dialogar com o Legislativo
O presidente do Supremo Tribunal Federal (STF), Luís Roberto Barroso, negou nesta sexta-feira (29) que exista uma crise institucional entre a Corte e o Congresso em função de decisões recentes, como o marco temporal para demarcação de terras indígenas.
Na primeira coletiva de imprensa após tomar posse, Barroso disse que a Constituição brasileira cuida de diversas questões, como saúde, educação, proteção do meio ambiente, criando “superposições” do Judiciário sobre matérias políticas. Contudo, o presidente negou interferência do STF nas atribuições do Congresso.
Nesta semana, após o Supremo finalizar o julgamento e vetar a aplicação do marco temporal, por 9 votos a 2, o Senado aprovou o marco. A aprovação ocorreu no mesmo dia do julgamento pelo plenário da Corte.
“Pretendo dialogar com o Congresso de uma forma respeitosa e institucional, como deve ser. Sinceramente, eu diria que não há crise. O que existe, como em qualquer democracia, é a necessidade de relações institucionais fundadas no diálogo”, afirmou.
O presidente também defendeu a nomeação de mulheres para cargos no Judiciário, mas evitou comentar a indicação que o presidente Luiz Inácio Lula da Silva deverá fazer para a vaga deixada pela ministra Rosa Weber.
“Eu defendo a feminilização dos tribunais de uma maneira geral. Mas, essa é uma prerrogativa do presidente [Lula]”, completou.
Marco Temporal – Sobre o marco temporal, Barroso disse que o Congresso poderá ter a última palavra sobre a questão se a aprovação do marco não ferir uma cláusula pétrea da Constituição.
“Em não se tratando de decisão sobre cláusula pétrea, o Congresso, no fundo, é quem tem a última palavra, porque ele sempre pode produzir uma emenda constitucional, revertendo uma interpretação do STF. Se for cláusula pétrea, não pode”, afirmou.
Forças Armadas – O presidente do STF também comentou a decisão do Tribunal Superior Eleitoral (TSE) que retirou as Forças Armadas do grupo de fiscalização das eleições. Os militares foram incluídos na comissão de transparência em 2021, quando Barroso presidiu a corte eleitoral.
“As Forças Armadas eram fiscalizadoras das eleições desde antes da minha gestão no TSE. O que eu criei, diante das acusações injustas e falsas de fraude, foi uma comissão de transparência. Lamentavelmente, as coisas não se passaram bem ali, porque o desejo era para que contribuíssem para a transparência e para a segurança, e trabalharam para levantar desconfianças”, concluiu.
Perfil –Barroso tomou posse ontem (29) na presidência da Corte e cumprirá mandato de dois anos. Ele chegou ao Supremo em 2013, indicado pela então presidente Dilma Rousseff para a vaga deixada pelo ministro Carlos Ayres Britto, aposentado em novembro de 2012 ao completar 70 anos.
O ministro nasceu em Vassouras (RJ), é doutor em direito público pela Universidade do Estado do Rio de Janeiro (Uerj) e mestre em direito pela Yale Law School, nos Estados Unidos.
Antes de chegar ao Supremo, atuou como advogado privado e defendeu diversas causas na Corte, entre elas a interrupção da gravidez nos casos de fetos anencéfalos, pesquisas com células-tronco, união homoafetiva e a defesa do ex-ativista Cesare Battisti.
