Aumento atingiria 40% dos consumidores residenciais no estado
A Associação Brasileira de Distribuidores de Energia Elétrica (ABRADEE) estima que as famílias de baixa renda podem ter um aumento de até 28% em suas contas de energia elétrica por causa da Reforma Tributária (PEC 45/2019). O texto, aprovado na Câmara dos Deputados e em discussão no Senado Federal, não menciona um regime especial para o setor ou redução de tributos sobre energia para as classes mais humildes.
Atualmente, o consumidor que tem tarifa social (consumo de até 100kw) tem um tratamento fiscal que desonera ou isenta a sua tributação no consumo, ou seja, não paga o ICMS (ou paga alíquotas menores) e outros tributos que incidem sobre a conta.
Se o texto da Reforma Tributária for aprovado como está, os estados poderão passar a cobrar alíquota de até 28% aos consumidores. No Maranhão, o aumento da tributação para as famílias de baixa renda vai atingir quase 1 milhão de clientes, o equivalente a 40% dos consumidores residenciais de energia elétrica do estado.
Hoje mais de 16 milhões de brasileiros são atendidos com a Tarifa Social e têm uma tributação isenta ou reduzida, dependendo do perfil de consumo e das regras aplicadas de estado para estado sobre impostos estaduais. Na prática, se não houver um tratamento especial para a energia elétrica na reforma tributária, esses consumidores terão um aumento de tributação real.
“Esse é um fato que preocupa e merece absoluta atenção. Não podemos permitir um regime tributário em que a arrecadação penaliza os mais pobres, ampliando desigualdades”, afirma Wagner Ferreira, Diretor Institucional e Jurídico da ABRADEE.
Além disso, a Abradee defende que definir no texto da reforma tributária que a energia elétrica é bem essencial à população é fundamental para evitar que esse insumo sofra no futuro com novos aumentos de impostos. A mudança é necessária porque, além de a energia elétrica ser um bem essencial para o crescimento econômico do país, a redução das contas de luz traz um impacto positivo para o Produto Interno Bruto (PIB) e para a população.
“É importante que a PEC da Reforma sinalize em direção a um regime especial para o setor elétrico, garantindo a energia elétrica com o tratamento adequado. É isso que vai dar segurança para quem mais precisa, para quem investe neste setor e para o motor do desenvolvimento da economia. A energia elétrica é o bem que mais gera prosperidade para a sociedade”, defende Ferreira.
O setor busca ainda evitar a incidência de imposto adicional seletivo sobre as contas de luz, já que os grandes prejudicados seriam os consumidores. Estudo do Instituto de Pesquisas Econômicas Aplicadas (Ipea) afirma que, a cada 10% de redução na conta de luz, é possível gerar um rebatimento positivo no PIB de 0,45% ao ano. Uma tributação simples e que defina a luz como bem essencial vai aliviar diretamente no bolso das pessoas, que poderão gastar menos com as contas de energia elétrica.
“A garantia do acesso à luz melhora a qualidade de vida da população. A energia mais barata favorece o ambiente econômico, aumenta a atividade industrial e a capacidade competitiva. É o chamado círculo virtuoso na economia, quando se reduz a tributação, o preço final do produto melhora, o que gera menor inflação e aumenta o poder de compra”, finaliza Ferreira.
