Rio de Janeiro, RJ, 13 (AFI) – José Perdiz de Jesus falou pela primeira vez como interventor e presidente em exercício da Confederação Brasileira de Futebol (CBF), nesta quarta-feira, ao emitir um comunicado, no qual afirma que fará ‘mínima interferência desportiva’. O dirigente tem 30 dias para realizar eleições na entidade que dirige o futebol nacional.
“Recebi com grande responsabilidade a indicação feita pelo Poder Judiciário para assumir temporariamente, na qualidade de administrador interino, a Confederação Brasileira de Futebol (CBF) até a realização das próximas eleições”, escreveu Perdiz no comunicado.
“É dever conduzir essa etapa transitória observando rigorosamente os marcos legais com independência e imparcialidade, em consonância com o estatuto da própria Entidade e da Fifa, tendo como único objetivo atender à determinação da Justiça. Nenhum prejuízo haverá para a entidade, já que toda administração será feita sem
solução de continuidade e com mínima interferência nas questões desportivas, que deverão ser tratadas pela futura gestão”, continuou.
“Neste período, daremos continuidade ao trabalho com transparência sobre a situação em que se encontra a CBF para conhecimento do eleito que venha a assumir o comando da entidade, de modo a garantir seu integral e regular funcionamento”, concluiu Perdiz.
Presidente afastado da CBF, Ednaldo Rodrigues sofreu nova derrota na Justiça nesta quarta-feira. Ele teve negado o recurso que apresentou ao Superior Tribunal de Justiça (STJ) e, assim, vai continuar longe do comando da entidade.
ENTENDA O CASO
O julgamento que acabou tirando Ednaldo do poder do futebol tratou da legalidade de um Termo de Ajustamento de Conduta (TAC) firmado entre a CBF e o Ministério Público do Rio de Janeiro (MP-RJ) em março de 2022. Na época, o TAC permitiu que a Assembleia Geral da entidade elegesse Ednaldo presidente. Na quinta-feira passada, porém, os desembargadores Gabriel Zéfiro, Mauro Martins e Mafalda Lucchese consideraram inicialmente que o MP não poderia ter ajuizado Ação Civil Pública (ACP) contra as eleições realizadas pela entidade em 2017, quando Rogério Caboclo foi eleito.
A revisão ocorreu a pedido de dois ex-presidentes da CBF, Ricardo Teixeira e Marco Polo del Nero. Assim, o TAC também foi considerado nulo. Outros dirigentes de federações também acionaram a Justiça.
A CBF e o MP-RJ firmaram o TAC porque o órgão da Justiça considerava ilegais as regras que regiam a eleição na confederação, ou seja, a que levou Ednaldo Rodrigues ao cargo de presidente. Isso porque uma mudança no estatuto da entidade, em 2017, estabeleceu pesos diferentes para os votos praticados por federações e clubes – a brecha permitia clubes e federações de votarem em conjunto para eleger o presidente. Foi sob essa regra que Rogério Caboclo elegeu-se presidente da CBF em 2017, indicado pelo então dirigente afastado Marco Polo del Nero. Caboclo foi destituído, em meio a denúncias de assédio.
Ednaldo, então vice-presidente da CBF, assumiu o comando de forma interina após o afastamento de Caboclo. Opositores tentaram barrar a eleição de março de 2022 alegando que o TAC fora assinado por ele, como presidente interino, e serviu para referendar uma eleição que o tornaria presidente de fato.
Em meio a essa movimentação na Justiça, que teria entre os articuladores cartolas afastados pela Fifa, na semana passada a entidade máxima do futebol mundial enviou uma notificação à CBF alertando que a entidade poderia ser suspensa caso Ednaldo Rodrigues fosse afastado “por influência indevida de terceiros”.
“Gostaríamos de lembrar que, de acordo com o art. 14 par. 1 i) e art. 19 dos Estatutos da FIFA, as associações membros da FIFA são obrigadas a gerir os seus assuntos de forma independente e sem influência indevida de terceiros. Qualquer violação destas obrigações pode levar a potenciais sanções, conforme previsto nos Estatutos da FIFA”, dizia trecho do documento.
“Além disso, e em relação ao acima exposto, gostaríamos de enfatizar que quaisquer violações ao art. 14 par. 1 i) dos Estatutos da Fifa também podem levar a sanções, mesmo que a influência de terceiros não tenha sido culpa da associação membro em questão (art. 14, parágrafo 3 dos Estatutos da Fifa)”, acrescentava o texto. Na quinta-feira, a Fifa e a Conmebol reiteraram o alerta, em resposta a consultas realizadas pelo secretário-geral da CBF, Alcino Reis.
