Ministra Rosa Weber encaminha reclamação à PGR
A vice-presidente do Supremo Tribunal Federal (STF), ministra Rosa Weber, no exercício da Presidência, encaminhou à Procuradoria-Geral da República (PGR) notícia-crime apresentada pela vereadora do Município de São Paulo Erika Santos (PSOL-SP), conhecida como Erika Hilton, contra o presidente da República, Jair Bolsonaro, pela suposta prática do crime de homotransfobia.
A remessa da notícia-crime à PGR faz parte do trâmite processual, uma vez que cabe àquele órgão requerer investigação nos processos de competência criminal no STF.
Na Petição (PET) 10470, a vereadora narra que na quarta-feira (13), ao participar da Convenção dos Ministros das Igrejas Evangélicas Assembleias de Deus (Comadesma) em Imperatriz (MA), o presidente proferiu discurso de cunho homofóbico e transfóbico, ao apontar “com desdém e desrespeito” a existência de pessoas com orientação sexual e identidade de gênero distintas do padrão heteronormativo.
Para Erika, ao usar o cargo que ocupa para ofender a dignidade de centenas de cidadãos brasileiros membros da comunidade LGBTQIA+, Bolsonaro manifesta institucionalmente a homotransfobia, prática considerada crime pela legislação brasileira.
A vereadora afirma ainda que o discurso do presidente atribui à comunidade LGBTQIA+ a alcunha da perversão e da prática de comportamentos negativos e desagradáveis à sociedade.
Ministra Rosa Weber encaminhou o caso à PGR
Reclamação – No entendimento da vereadora, durante o evento no inerior do Maranhão, o chefe do Poder Executivo defendeu que “o Joãozinho seja Joãozinho a vida toda” e que “a Mariazinha seja Maria a vida toda”.
Além disso, reclama, Bolsonaro teria dito que, para ele, o modelo de família é composto por “homem, mulher e prole”. O chefe do Executivo ainda disse que ao longo do governo do ex-presidente Lula (PT) aconteceu o que chamou de “desconstrução da heteronormatividade”.
Em seu perfil no Instagram, Erika justificou sua ação: “As falas do homem que ocupa a presidência do Brasil até dia 31 de Dezembro não podem ser encaradas como ‘liberdade de expressão’ ou ‘cortina de fumaça’”.
Ela prossegue: “Discursos de ódio vindos de quem ocupa o cargo mais representativo do país alimenta uma onda de violência que acaba de tirar a vida de um Guarda Civil metropolitano no Paraná, em sua festa de aniversário”, concluiu.
