Lava a jato foi interditado por apresentar diversas irregularidades (Foto: Divulgação)
O lava a jato instalado às margens da BR-222, no município de Vargem Grande, foi interditado pelo Corpo de Bombeiros, após vistoria realizada na quinta-feira (2), a pedido do Ministério Público do Trabalho no Maranhão (MPT-MA) e Superintendência Regional do Trabalho (SRT).
De acordo com relatório do Grupamento de Atividades Técnicas (GAT), do Corpo de Bombeiros Militar do Maranhão, as instalações elétricas da casa de abrigo dos compressores utilizados no lava a jato estão fora das conformidades, oferecendo risco de descarga elétrica aos usuários.
Outras irregularidades identificadas foram ausência de projeto de energia de baixa tensão para uso comercial, com isolamento das partes elétricas expostas, e falta de plano de gerenciamento de risco. O local foi interditado.
A vistoria foi feita pelo tenente Noslem e pelo major Siqueira, do 11º Batalhão de Bombeiros Militar (11º BBM), de Itapecuru-Mirim, responsável pela cobertura de atendimento em Vargem Grande e demais municípios circunvizinhos.
DEZ DIAS PARA REGULARIZAÇÃO
O proprietário do estabelecimento recebeu um prazo de dez dias para regularizar a situação. Ele terá que pagar taxa de R$ 152,10 pela vistoria. O descumprimento da notificação do Corpo de Bombeiros implicará em penalidades administrativas como multas, apreensão, embargo e interdição, previstas na Lei Estadual Nº 6.546/1995.
SEIS ADOLESCENTES TRABALHAVAM NO LAVA A JATO
Esta semana, seis adolescentes entre 13 e 17 anos de idade foram flagrados em situação de trabalho infantil no lava a jato. A fiscalização ocorreu no dia 30 de maio e foi feita pelo MPT-MA em parceria com a SRT.
A procuradora do Trabalho Virgínia de Azevedo Neves e a auditora fiscal do Trabalho Léa Cristina Leda foram responsáveis pela ação fiscal.
OUTRAS PENALIDADES
O dono do lava a jato ainda está sujeito a penalidades da Auditoria Fiscal do Trabalho, que deve lavrar autos de infração pelas inúmeras irregularidades trabalhistas encontradas, e à ação do Ministério Público do Trabalho, que irá instaurar procedimento para cobrar a responsabilização do proprietário e exigir o fim da exploração de adolescentes no estabelecimento.
Pelo MPT-MA, uma vez aberto, o inquérito civil pode resultar na assinatura de termo de ajustamento de conduta (TAC) com o dono do lava a jato ou ajuizamento de ação civil pública na justiça trabalhista, com pedido de pagamento de dano moral coletivo por causa dos prejuízos causados à sociedade brasileira pela exploração dos adolescentes.
Diante da situação flagrada pela ação fiscal, o município de Vargem Grande e as instituições que integram a rede de proteção da criança e do adolescente foram acionados para tomar as medidas necessárias.
O trabalho em lava a jato é proibido pela legislação brasileira a pessoas com menos de 18 anos, por conta dos riscos ocupacionais e danos à saúde dos jovens.
