IMPERATRIZ – O Ministério Público do Maranhão conseguiu decisão, em caráter liminar, nesta quarta-feira, 15, contra o Estado do Maranhão, para que a Agência Estadual de Mobilidade Urbana e Serviços Públicos (MOB) realize fiscalizações regulares e contínuas com o objetivo de combater o transporte clandestino nas linhas de transporte coletivo intermunicipal que ligam Imperatriz aos municípios de Davinópolis, Governador Edison Lobão, João Lisboa e Senador La Rocque.

A liminar foi provocada por Ação Civil Pública proposta pelo MPMA, em novembro de 2021, após operações realizadas entre os meses de julho e agosto. Além do Ministério Público, também participaram a Secretaria de Trânsito e Transportes de Imperatriz, a Agência Nacional de Transportes Terrestres – ANTT, Secretaria da Fazenda, Polícia Militar, Polícia Rodoviária Federal e a própria MOB.

Nas operações realizadas, evidenciou-se que a falta de fiscalização regular permite que o transporte coletivo clandestino aumente de maneira a inviabilizar economicamente a operação do sistema de transporte coletivo intermunicipal pelas empresas autorizadas.

O titular da 2ª Promotoria de Justiça Especializada na Defesa do Direito do Consumidor em Imperatriz e autor da ACP, Sandro Bíscaro, ressalta que o problema de fiscalização da MOB já é antigo e que o MPMA tentou resolver a questão extrajudicialmente por diversas vezes, inclusive sugerindo um convênio com outros órgãos para viabilizar as operações, mas sem êxito.

“A falta de fiscalização deu origem a um ciclo vicioso: os veículos clandestinos deixam de circular nos raros dias de fiscalização. No entanto, a falta de regularidade na atuação da Agência permite que as vans voltem a operar normalmente no dia a dia”, destaca Sandro Bíscaro.

Além das fiscalizações, a decisão também estabelece que a MOB adeque o número de vans em circulação de acordo, de acordo com a legislação, ao número de habitantes (uma van para cada dois mil habitantes), e autorize concessões de linhas de transporte alternativo intermunicipal até o limite máximo de 45 km.

A agência tem o prazo de 90 dias para realizar as fiscalizações periódicas sob pena de multa diária de R$ 10 mil em caso de descumprimento.
