Deputado foi condenado pela Corte a oito anos e nove meses de prisão

A Procuradoria-Geral da República (PGR) pediu nesta terça-feira (14) ao Supremo Tribunal Federal (STF) a extinção da pena do pena do deputado federal Daniel Silveira (PTB-RJ), condenado pela Corte a oito anos e nove meses de prisão pelos crimes de tentativa de impedir o livre exercício dos Poderes e coação no curso do processo.

Na petição, a vice-procuradora Lindôra Araújo também pede que todas as medidas cautelares impostas ao parlamentar, como multa pelo desuso de tornozeleira eletrônica, sejam suspensas.

Para a procuradoria, decreto do presidente Jair Bolsonaro que concedeu graça constitucional à pena do deputado tem validade e a extinção da punibilidade deve ser declarada pelo STF.

“O decreto de indulto individual é existente, válido e eficaz, sendo que a sua repercussão jurídica na punibilidade está condicionada à necessária decisão judicial que declara extinta a pena do condenado. A natureza jurídica dessa decisão judicial, por sua vez, angaria cunho declaratório, pelo que, após o provimento jurisdicional, a extinção da pretensão penal retroage à data de publicação do referido decreto no Diário Oficial da União“, argumentou.

Em maio, a defesa de Silveira também pediu ao Supremo o reconhecimento da extinção da punibilidade de Daniel Silveira em função do decreto.

Segundo os advogados, o deputado também não pode ser alvo de medidas cautelares determinadas pelo ministro Alexandre de Moraes em outro processo, como o uso de tornozeleira eletrônica, bloqueio de contas bancárias, entre outras.

“Portanto, considerando que há Decreto Presidencial válido e em vigor no tempo presente extinguindo a punibilidade do agravante em razão da concessão de graça, requer seja declarada extinta a punibilidade em razão da graça concedida e, por conseguinte, seja reconhecida a ineficácia de todas as medidas cautelares decretadas nos presentes autos, inclusive a sanção pecuniária contida na decisão agravada”, disse a defesa.
