Também foram condenados um empresário e a ex-chefe do Departamento Administrativo da Câmara
Em atendimento a pedido do Ministério Público do Maranhão, a Justiça condenou o ex-presidente da Câmara Municipal de Açailândia Josibeliano Chagas Farias, o Ceará, e sua ex-chefe do Departamento Administrativo, Regina Maria da Silva e Sousa. Ambos pegaram 12 anos de reclusão, a serem cumpridos inicialmente em regime fechado, pelo crime de peculato.
A sentença foi assinada no último dia 27 de outubro pela juíza Selecina Henrique Locatelli, titular da 2ª Vara da Comarca de Açailândia.
Os réus também foram condenados a 363 dias-multa, fixando-se cada dia-multa em cinco vezes o salário mínimo vigente à época do fato, aumentada ao triplo, para o ex-presidente da Câmara, e em duas vezes o salário mínimo da época, para a ex-chefe do Departamento Administrativo.
Na mesma sentença, foi condenado o representante da empresa ANM da Silva Supermercados Marcos Paulo Andrade Silva a cinco anos e quatro meses de reclusão e ao pagamento de 155 dias-multa, sendo cada dia-multa fixado em três vezes o salário mínimo da época do fato.
Conforme a denúncia do Ministério Público, formulada em setembro de 2018, pela então titular da 1ª Promotoria de Justiça de Açailândia, Glauce Mara Lima Malheiros (atualmente titular da 1ª Promotoria de Justiça Especializada de Imperatriz), os condenados desviaram uma quantia de R$ 281.823,07 dos cofres públicos, em proveito próprio ou alheio, decorrente de contratos firmados entre a Câmara Municipal e o supermercado.
Um dos contratos tinha como objeto a aquisição de materiais de consumo, dentre eles alimentos, descartáveis, material de limpeza, material de higiene e utensílios de cozinha, e o outro objetivava a compra de material de expediente (papelaria), ambos para atender a demanda da Câmara Municipal, no exercício financeiro de 2017.
Investigacoes – Nos dois casos, as investigações do Ministério Público apontaram uma série de irregularidades, desde a realização dos processos licitatórios até a suposta entrega dos produtos. No contrato de material de escritório, por exemplo, foram incluídos itens como 10 caixas de disquetes de computador, 1 mil lápis e 50 mil fotocópias. Uma inspeção realizada pela Promotoria verificou que o fornecedor contava apenas com duas impressoras de uso doméstico (que seriam utilizadas para o fornecimento de 50 mil fotocópias) e, dos itens constantes do contrato, tinha em estoque apenas lápis, canetas e borrachas.
Outra inspeção foi realizada na sede da Câmara, para verificar a existência dos bens duráveis supostamente adquiridos, como 10 saboneteiras plásticas, que não foram encontradas. Havia apenas duas, antigas, apesar da sede do Legislativo Municipal ter sete banheiros. De 20 grampeadores, nenhum foi encontrado e das três fragmentadoras de papel que teriam sido entregues, foi encontrada em uso somente uma, de modelo diferente e em avançado estado de uso.
Também não foram encontradas 200 baterias de nove volts, três garrafas térmicas, 100 bobinas para fax, 100 disquetes, 60 fitas para impressora, porta-copos, pranchetas, quadro branco entre outros itens. De acordo com a chefe do Setor Financeiro da Câmara de Vereadores, blocos de cheques (100 adquiridos) e recibos de salários (6), que também são itens faltantes, há muito tempo não são utilizados, pois o sistema é informatizado. Ainda entre os itens não mais utilizados, além de disquetes de computador, estão 60 fitas VHS.
Outro ponto que chamou a atenção do Ministério Público foram as quantidades exorbitantes de produtos adquiridos. De açúcar, por exemplo, foram três mil quilos; de papel A4, 3 mil resmas, o que representa 1,5 milhão de folhas; e de refrigerantes, 3 mil litros.
Comparativamente, a ata de registro de preços do Supremo Tribunal Federal (STF), com 1738 servidores e com processos judiciais de todo o país, para a compra de papel previa quatro mil resmas. No mesmo ano, a Câmara Municipal de Açailândia, com cerca de 100 servidores, incluindo os vereadores, teria adquirido três mil resmas de papel.
Reparacao do dano – A sentença judicial também condenou os réus, solidariamente, a pagar o valor de R$ 281.823,07 ao erário municipal, a título de reparação mínima dos danos causados pela infração, acrescidos de correção monetária calculada pela Corregedoria Geral de Justiça do Tribunal de Justiça do Maranhão, bem como incidirão juros à razão de 1% ao mês, ambos desde a publicação desta sentença até o efetivo pagamento.
